Since September 1st this year, the management of exports involving 58 precursor chemicals has been strictly regulated. These regulations cover the entire lifecycle of precursor chemicals, including their production, management, purchase, transportation, import, and export. The main objective is to prevent the unauthorized use of these substances in the illegal manufacture of drugs. Starting November 1, 2005, the newly issued "Precursor Chemicals Management Regulations" will enforce a licensing system for all activities related to precursor chemicals.
According to the "Regulations on the Administration of Precursor Chemicals," passed at the 102nd executive meeting of the State Council on August 17, precursor chemicals are classified into three categories. The first category includes primary raw materials that can be used for drug production, such as pepper aldehyde, with a total of 12 listed substances. The second and third categories consist of chemical compounds that can be used in the production of illicit substances. Examples of second-category chemicals include phenylacetic acid, acetic anhydride, chloroform, ethyl ether, and piperidine, while third-category substances include toluene, acetone, methyl ethyl ketone, potassium permanganate, sulfuric acid, and hydrochloric acid.
Under the new regulations, applications for the production of first-category precursor chemicals must be reviewed and approved by the State Council's Food and Drug Administration. For non-pharmaceutical first-category precursor chemicals, approval is required from the provincial or municipal safety supervision departments.
The "Regulations" explicitly prohibit smuggling, illegal production, trading, purchasing, transferring, or transporting of precursor chemicals. Cash or barter transactions for these substances are also strictly forbidden. All entities involved in the manufacturing, handling, purchasing, transporting, importing, or exporting of precursor chemicals are required to establish internal management systems to ensure compliance.
Furthermore, the regulations emphasize strict enforcement against unauthorized operations, including unregistered production, sale, or transportation of precursor chemicals. Any fraudulent use of raw materials to obtain production licenses will be met with severe legal consequences. This comprehensive approach aims to strengthen control over these sensitive substances and reduce their misuse in illegal activities.
